When submitting development applications (DA) in the Manly Ward of the, Northern Beaches Council, you may be required to give consideration to the:
1. 'Long Nosed Bandicoot endangered population' in North Head/Manly, or the
2. 'Little Penguin endangered population' in Manly.
Such an assessment is required under the Manly Local Environmental Plan, (LEP), Manly Development Control Plan (DCP) and the NSW Biodiversity Conservation Act 2016 (BC Act) Environmental Planning and Assessment Act 1979 (EP&A Act).
If you are submitting a DA in the area where Little Penguins or Long-nosed Bandicoots occur you will need to address Council’s requirements for assessment of the proposal. One such requirement is an 5-Part Test (formerly 8 -Part test or 7-part test). This requirement is specified in the Manly Development Control Plan for the Residential Zone 2001. An ‘5 Part Test’ must be carried out in accordance with the BC Act and EP&A Act if the subject site is potential habitat for or may impact on an endangered population, of Long-Nosed Bandicoot as identified under the BC Act.
Ultimately, it is left to the discretion of Council to determine if a development will have a significant impact on the Long Nosed Bandicoot or their habitats, however you will require a report prepared by a suitably qualified Ecologist such as Land Eco Consulting to ensure your DA addresses the:
1. Requirements of the LEP
2. Test of Significance of impacts to the Long-nosed Bandicoot or Little Penguin
